7:10    CARPENTER, Steve and June – information on re-use  RR4
        Old Ware Lumber Company Property
        Former owner and second mortgage holder of property.
        Trying to find a good re-use of property
        Railroad may be interested
        Two separate lots, both in RR4, which is stricter than HC
        Wholesale not allowed in RR4

CD      May be easier to change the boundary location to include
        those two lots in HC, then to allow a use in entire zone.
        Easier sell to Town to change boundary line.
        Grandfathered for RETAIL use
        Wholesale is NOT ALLOWED
Contractor is considered a SERVICE and is allowed by SP in RR4

Petition the board of selectmen to petition Planning Board to change the boundaries of the two lots to HC.  May take a year.
Most likely, you would need to file a Special Permit.

HC is basically on the main artery coming thru the Town and out with business’.
It does not negate opening up for RETAIL business because it is grandfathered.

JK      You may loose it on Town Hall Floor if you do not have a specific type of business in mind.

RS      abandoned for two years ?
CD      look up the definition of abandonment…  Right now it is a time capsule for RETAIL establishment.  Until someone comes into the town and wants to change the use, it will remain a RETAIL grandfathered use.
Even Site Plan Approval wouldn’t be too difficult because the infrastructure is already in place.

Depending on traffic impact, PB and Applicant will work together on what is the best entrance to use.


7:20    PROVENCAL, Bob
        Estate lot question.  111 Walker Road
        24 acres. Can there be access for two estate lots on Right of Way.

CD      Two lots can share a driveway.
        Brook goes down to Pelski’s pond by Crescent Street.
        Brook has impacted the property that egress’ off addressStreetGreenwich Road.
        We could sign off but there would be a burden with Conservation.
        Police or Fire may say that it is a safety issue with house numbering.
        I would check with Police and Fire first.  Legitimate concern.


7:30    CAMPBELL, Rob – information on Home Occupation Business

7:40    PIERCE – Belchertown Road – request for continuance on SP until 09-30-2009
        CONDITIONS, SAFEGUARDS, stocktickerAND LIMITATIONS ON TIME OR USE
§       A Certificate of Occupancy will not be granted to the Applicants until
the existing (old) mobile home is demolished and all debris removed from site.
§       The existing (old) mobile home must be removed no later than 05-31-2009.

        Request for Technical Assistance to re-organize by-laws.
        Re-number – some do not have numbers, some repeat numbers

Rick:           I would rather eliminate page numbers
Danielle:       it might help to have page #’s for quick reference.

                If we can make it flow more, that would be helpful.

        Roger Mundell – Realtor for Old GVille Bottled Gas (Osterman) Building.

        Can he rent out office space when he is done with storage ?
        It was previously used as an Office.

RS      is it an abandoned use ?

                MGL C 40A – Section 6  Regulating of Nonconforming Uses After 2 Years
                  A zoning ordinance or by-law may define and regulate non-conforming uses
                  and structures abandoned or not used for a period of two years or more.


CD      was never an office building, they had a service/retail business and used the space for their office too.  He could use it for his own personal office space.
        He would not be able to split the building and rent out ½ as office space.
        Office building is over 2,000 SF according to our definition.
        May be 1,200 SF building

CD      provided that the use never gets changed.  ie: someone comes in and says I am changing the use to a restaurant.

        Existing RETAIL/SERVICE component use.
