        Martin and Robin Murphy present

CD      The removal of gravel from Lot 3 is illegal without a building permit
Gravel can only be removed in conjunction with a building permit or with
        an Earth Removal Permit.
The Building Inspector determines how much gravel is incidental to building.
At the meeting of 12/6/06, Mrs. Murphy was going to return with figures on 1/3/07.

        Murphy
Martin Murphy stated that he traded site work with Mike Snow for the gravel.
Murphy states he did not know that Mike Snow was going to remove so much gravel.
Murphy does not know how much gravel was removed.
Murphy states that the bank was not lowered, just pitched

        DISCUSSION
Board asked what the existing conditions/grades were prior to April 2006
How did Russo establish the top of the bank
What is the grade at now ?  elevation ?
Selling gravel is not fair to the legal earth removal operations in Town.

At the next meeting of the PB on 2/21/07, the Murphy’s will bring in information from Russo on how the top of the bank was established, how much gravel was removed wince April 2006 from Lot 3 or from Lots 2 and 3 combined.
