CERTIFIED COPY OF VOTE


        At a legal meeting of the qualified voters in the Town of Ware held on September 24, 1991 the following action was taken under Article 18:

            Voted by majority that the Town adopt a Skateboard Control By-Law as follows:
                                   

REVISED TOWN OF WARE SKATEBOARD CONTROL BY-LAW


SECTION I. UNLAWFUL ACTIVITIES:

A. No person shall use, operate, or ride a skateboard upon or in any of the public or private places or rights-of-way listed in Section II.  hereof.
B. No person shall use, operate, or ride a skateboard upon any public or private property or right-of-way.
1. In a careless manner without due caution and circumspection; or
2. In any manner which creates a risk or danger to any person or property; or
3. In any manner which impedes or interferes with pedestrian or vehicular traffic.

SECTION II. RESTRICTED AREA:

            The places referred to in Section I., A where use of skateboards is prohibited   
             are as follows:

1. Public and private sidewalks and driveways, and roadways of the
following public ways, except one’s own property:
a. Main Street;
b.West Main Street;
c.North Street;
d. Parker Street;
e. West Street;
f. Bank Street;
g.Church Street from Walnut Street to Main Street;
h. South Street;
i. East  Street; and
j. East Main Street.

2. The Municipal Parking Lots located as follows:
a. the Main Street Municipal Parking Lot adjacent to Veterans
Memorial Park; and
b. the Bank and Pleasant Streets Municipal Parking Lot, also known
as the Mount Carmel Parking Lot.

SECTION III.  VIOLATIONS AND PENALTIES:

            A police officer of the Town of Ware who shall observe any person using,
            operating or riding upon a skateboard in violation of this by-law shall:

1. Upon the first violation, issue a written notice of the violation to the
offender which provides for a fine of Twenty-Five Dollars ($25.00).         
2. Upon the second violation and upon each subsequent violation, issue a
written notice of the violation to the offender which provides for a fine
of Fifty Dollars ($50.00) for each offense.
